ELKTON, Md. (AP) — A Cecil County Circuit judge has denied a motion by a man accused of killing an 11-year-old girl to remove the option of a death sentence.

The denial was made Thursday on the motion by lawyers for Thomas J. Leggs Jr.

Leggs, 31, is charged with murder and other offenses in the kidnapping and slaying of Sarah Foxwell. Her burned remains were found Christmas Day 2009 in Wicomico County. His trial has been moved to Cecil County.

    I agree w/ you Sheriff willie. Even tho, he won’t suffer as much as he made Sarah suffer, I say keep him alive for the immates. He’ll get his due justice in jail.

    Punishment and murder are processes of revenge and the death sentence is the easiest way for our society to answer the victim, and give them closure. Teach the people that revenge is wrong as is punishment. If a man kills your child his dEATH WILL NOT BRING THE CHILD BACK AND HE WILL NOT HAVE LEARNED HIS LESSON. sO WHAT HAPPENS. hE MUST BE BORN INTO THE WORELD AGAIN AND GROW UP TO BECOME A MURDERER ONCE AGAIN, ONLY TO BE PUT TO DEATH AGAIN AND STILL NEVER LEARN HIS LESSON. hOW ABOUT WE REHABILITATE THESE PEOPLE SO WE CAN LEARN MORE ABOUT WHY THEY DO THESE HORRIBLE THINGS IN THE FIRST PLACE AND THEY LEARN WHY THEMSELVES. We need to start teaching our children that punishment and revenge are wrong completely and in every way. And yes i would say the same thing if someone were to do those things to my child; even though i would mourne and suffer within imnmmensely.

    Instead of an eye for an eye how about we forgive our brothers and sisters seventy seven times in a single day? How about we remember that every one of us is capable of the same acts in life.What is you were to do all the thinngs you have thought up in your mind, would you7 have not done some pretty horrific things in life as well? Don’t judge if you don’t understand human nature and the human mind. Check into what your own leaders have done to our people in the world and then consider whether you shpuld throw rocks at this man. Forgive and rehabilitate, that is the way. Punishment is wrong, and so is revenge.

      Well Daniel, you go right ahead and forgive whoever you want; and go ahead and try to rehabilitate whoever you want. In the meantime, someone who commits this kind of crime (and several others) deserves the death penalty. Maybe in this animals next life, he will meet up with you and the two of you can discuss it as he is holding a match to you after dousing you with lighter fluid. You are a real nutcase.
