Delegate To Discuss In-State Tuition Lawsuit

ANNAPOLIS, Md. (AP) -- A Maryland lawmaker says the judge presiding over a lawsuit over in-state tuition for illegal
immigrants should recuse himself from the case.

Republican Delegate Pat McDonough has scheduled a news conference on Friday.

McDonough says Anne Arundel County Circuit Judge Ronald Silkworth ruled last year that an ordinance to allow a casino was part of an appropriation package for state government and not subject to a referendum. His ruling was later overturned.

McDonough says the ruling is significant, because an attorney for supporters of in-state tuition for illegal immigrants is making a similar argument to quash a referendum on the issue in November 2012.

Kim Propeack, an attorney for Casa de Maryland, notes that the lawsuit also challenges thousands of signatures gathered online in a manner susceptible to fraud.
