Aruba Orders Release Of Gaithersburg Man Suspected In Death

BALTIMORE (WJZ)-- Drama in Aruba as a judge rules police must release Gary Giordano-- the prime suspect in the disappearance of his lover.

Mike Hellgren tells us when he may be coming back to Maryland.

After more than 100 days in an Aruban jail, Gary Giordano may soon be a free man.

A judge there says prosecutors have not made enough progress investigating the disappearance of his lover, Robyn Gardner.

"When I asked him what he really feels about his release, he started to cry," Chris LeJuez, Giordano's attorney, said.

Giordano claims Gardner drowned while snorkeling. Her body was never found.

She also has a boyfriend here in Maryland who believes Giordano knows where she is.

"I hope every day is a day in hell for him that brings him closer to breaking and saying what happened," Richard Forester, Gardner's boyfriend, said. "I hope that if he is released, somebody's waiting to pick him up here on the U.S. side."

The FBI's Baltimore Field Office still has an open investigation into Giordano, and they did raid his home in Montgomery County.

The case has generated international headlines, including salacious details of Giordano's swinger lifestyle and criminal past. And that he tried to cash-in a million-dollar insurance policy he took out on Gardner.

"With our constitutional protections, the laws are probably better for him in this country than if he were in Aruba," said Byron Warnken of warnkenlaw.com.

Gardner's boyfriend still believes that after vanishing four months ago, she's still alive– until someone shows him proof she's not.

"That would be giving up, and I'm not going to do that," he said. "I know she wouldn't give up on me."

Giordano has not been charged in Maryland with anything related to Gardner's disappearance.

Giordano has been in jail for 112 days and continues to maintain his innocence.
