BALTIMORE (WJZ)– A 7-year-old boy who was hospitalized on Thursday after being hit by a vehicle in Northwest Baltimore has died.

Marcell Wagstaff was riding his bike on the street in front of his house in the 5700-block of Rubin Avenue when he was struck by a Toyota Highlander.

The preliminary investigation points to pedestrian error as the cause of the accident but prosecutors will have the final say on whether charges are filed.

The driver did remain at the scene of the accident.
