BEL AIR, Md. (AP) — A man serving a life sentence for a road-rage killing in 1981 has been freed after a letter by the prosecutor said he should not have been convicted of first-degree murder.

Harford County Circuit Judge Stephen Waldron released Pete Kosmos Jr., 56, on Monday after current state’s attorney Joseph Cassilly did not object. Cassilly said Kosmos’ murder conviction will remain on his record.

According to The Daily Record of Baltimore, former assistant Harford County State’s Attorney Edward Lilly wrote in a 1994 at the request of Kosmos’ family that conviction should have been for second-degree murder or manslaughter.
