Accused Killer Fights Extradition From Del. To Md.

DOVER, Del. (AP) -- A Sussex County man accused of killing a fellow church worker is fighting extradition to Maryland.

A justice of the peace in Georgetown denied a defense request Monday to stay the extradition of Matthew Burton, 28, of Dagsboro pending the filing of a habeas corpus petition in Superior Court.

But after the petition was filed, a Superior Court judge ordered that Burton remain in the custody of Delaware prison officials pending an Aug. 16 hearing on his extradition challenge.

Burton is charged with killing 35-year-old Nicole Bennett, whose body was found in an embankment in Worcester County, Md. in June.

Bennett's husband reported her missing to Delaware State Police on June 15 after she didn't return home from her job at a Gumboro church where Burton worked as a custodian.
