Lawsuit Challenging New Market Growth Plan Tossed

NEW MARKET, Md. (AP) — A Frederick County judge has dismissed a legal challenge to growth plans in the town of New Market.

The Frederick News-Post reported Friday that the lawsuit filed by the Friends of Frederick County was dismissed Wednesday.

The ruling marks a victory for Mayor Winslow Burhans. He supports increased development and a more diverse mix of employers in the town of about 700. New Market was once marketed as the “antiques capital of Maryland.”

The plaintiffs alleged that the town’s master plan didn’t meet state requirements and could lead to out-of-control growth, environmental damage and higher taxes.

The court found the plan in compliance with state law.

The Town Council recently relaxed some restrictions on development. The town is considering annexations that would double its size.
