GREENBELT, Md. (AP) — Maryland officials want a judge to dismiss an effort by convicted sniper Lee Boyd Malvo to challenge his life without parole sentence.

Malvo was convicted in Maryland and Virginia for his role in the 2002 sniper shootings that killed 10 people and wounded three in Virginia, Maryland and the District of Columbia.

Earlier this year Malvo, who was 17 at the time of the killings, challenged his sentences based on a recent Supreme Court decision outlawing mandatory life sentences without parole for juveniles.

Maryland’s attorney general’s office filed a court document Friday arguing that Malvo’s petition should be dismissed because he would need to file it in state court first and because his petition is too late.

The Virginia’s attorney general’s office also opposed a similar challenge in that state.
