Md. Boy's Appeal Denied In 'The Pop-Tart Gun Case'

ANNAPOLIS, Md. (AP) -- School officials have rejected an appeal filed by the family of a Maryland boy suspended after chewing his breakfast pastry into the shape of a gun.

In an Oct. 9 opinion, the Anne Arundel County Board of Education wrote that staff members at Park Elementary School "acted reasonably and properly" by suspending the then-7-year-old boy last year.

In June, a hearing examiner also affirmed the boy's suspension, finding that it was based on a history of problems, not the pastry episode some refer to as "the Pop-Tart case."

The attorney for the boy's family, Robin Ficker, told The Washington Post on Wednesday that his parents will now appeal to the Maryland State Board of Education in hopes of getting the incident cleared from his school record.
