Baltimore Officers Cleared In 2014 Police Shooting

BALTIMORE (AP) -- A Baltimore Police review board has found that two officers who shot and injured a man who pointed a BB gun at them acted in accordance with department policy.

The report, dated April 6, says Officers Edward Mendez and Jacqueline Fillion's use of force in the incident last year was "in policy" and no further action was required.

The report says on Feb. 21, 2014, Mendez and Fillion encountered 22-year-old Clarence Berry after a man said Berry had robbed him and had a handgun.

According to the report, when the officers saw Berry, Mendez drew his gun and Berry pulled out a handgun. Mendez and Fillion shot Berry after he refused to drop his weapon, which was a Daisy Replica BB gun.

Berry survived and was convicted on assault charges.
