Mistrial for Carryout Owner Accused of Shooting Customer

BALTIMORE (AP) — The trial of a West Baltimore Chinese carryout owner accused of shooting one of his customers has ended in a mistrial.

Local news media outlets report that a judge declared a mistrial in Fu Tan's attempted-murder case on Friday after jurors failed to reach a unanimous verdict.

Tan testified earlier this week he was trying to scare off unruly customers when he fired his handgun three times into the ground in February. One of the bullets hit the leg of a man who had left the store. Tan said he feared he was going to be robbed.

Prosecutors argued that they believe Tan was trying to kill the man.

Baltimore State's Attorney Marilyn Mosby's office says they intend to retry the case in February.
