Passenger Identifies Accused Cop Killer As Gunman

GEORGETOWN, Md. (AP) -- A fellow passenger in a car stopped by police after a failed robbery attempt has identified a Maryland man as the gunman who fatally shot a Delaware police officer.

Luis Flores, 23, testified Wednesday that Derrick Powell shot Georgetown patrolman Chad Spicer in September 2009.

Flores said he and Powell were in the back seat of a car driven by a third man with whom they had plotted to rob a drug dealer the day Spicer was shot.

Flores, who tried to help Spicer after he was shot, tearfully testified how he told the mortally wounded officer "not to die."

Flores was never charged with any crime. Powell, from Cumberland, Md., could face the death penalty if convicted of first-degree murder.
