Trial Dates Set For 3 In Boy's Fatal Beating Over Cake

HAGERSTOWN, Md. (AP) -- Trial dates have been set for three people accused of fatally beating a 9-year-old boy over a missing piece of birthday cake.

Jack Garcia's mother, Oriana Garcia, and her brother Jacob Barajas are scheduled for separate trials Jan. 12 in Washington County Circuit Court in Hagerstown.

Garcia's boyfriend, Robert Leroy Wilson, has a trial set for Dec. 15.

All three are charged with second-degree murder and other offenses.

The boy died July 5, five days after paramedics found him unresponsive in the Hagerstown apartment where all four people lived.

Garcia has pleaded not guilty to the charges. Barajas and Wilson haven't entered pleas.

Wilson's public defender declined to comment on the case Wednesday. Barajas has a private attorney who didn't immediately return a call from The Associated Press.
