Retrial Set In June In Rape Case

EASTON, Md. (AP) -- A new trial is set for an Easton man who was convicted in 2006 of rape.

The Maryland Court of Special Appeals ruled in April that Benjamin Gardner, 51, should have a new trial.

Gardner was charged in late 2005 with sexually assaulting a girl over a nine-year period.

The Court of Special Appeals ruled that testimony by a state witness in the trial was not admissible.

The new trial is set for June. 6.
