Judge: Baltimore Gun Registry Unconstitutional

BALTIMORE (AP) — A Circuit Court judge has found Baltimore’s 4-year-old gun registry law to be unconstitutional in a nonbinding opinion.

The Baltimore Sun reports that Judge Alfred Nance said the city police department had failed to establish clear regulations for the registry, and that the program was “unconstitutionally vague and overly broad.”

The program requires those convicted of gun crimes to furnish addresses and other information to the city every six months for three years. Nance said a requirement that they provide “any other information” required by department rules seems to give police “limitless discretion.”

Sheryl Goldstein of the mayor’s Office on Criminal Justice said officials are pleased the opinion did not find the program conflicted with state laws. The city may appeal. The public defender’s office brought the challenge.

    Judge Alfred Nance is a totaly stupid ass and maybe he should indure a shooting of himself or one of his loved ones so he can understand.The law is niether overly broad nor vague in any way.     These comments are all by idiots. If you READ the article, it says that the problem is with the police departments “vague” requirement that the offenders provide any additional information… we all know how police are simply the enforcement engine of the state/local municipality’s revenue engine, so it’s bound to be open loophole for further financial abuse of the public. If crime is so bad, why are they creating a registry instead of doing something about the grass-roots cause of crime? (Poverty). Instead they fatten their pockets with illegal deals with tow companies and fatten the pockets of the state with fines from traffic tickets. If the police aren’t going to provide any safety benefit, then let us defend ourselves with concealed carry laws. This registry idea is stupid. And if you think it will make any difference to crime, then you are stupid. Stop making more registries and go out and stop some crime.

    I’m a proud NRA member, 2nd Amendment activist and gun lover. I believe that all non-criminal, non-substance abuser, and non-mentally ill Americans have a right to “keep and bear arms” just like the US Constitution says and the US Supreme Court finally ruled on June 28, 2010. I feel that these “gun registries” are very open to abuse on persons convicted of very minor “gun crimes” who had no intention of committing a crime such as forgetting to remove a gun from the car trunk after going to a shooting range or having the gun serviced at a gunsmith. Under current Maryland State Law, you may only transport a gun in your vehicle if you are going directly from you home to a shooting range or gunsmith and then back home again. Under this law (which I find unfair), if you first stop to get gas, or even to pick up your friend to go to the gun range with you on your way to the range, you can be charged with a gun crime. So now that you’ve been convicted of this very unfair Maryland gun transportation law–you can now be put on that unfair gun registry. It’s Ultra-Liberal “feel good” gun laws like this that slowly errode away our civil rights. What needs to be done is longer criminal sentences that actually stick for those convicted of actual violent gun crimes. Baltimore is full of hard core criminal repeat offenders who are emboldened by the fact that they will do very little time in prison for their dispicable violent crimes. Stop making all these stupid and unfair gun laws that don’t work and just do what’s right and send away the violent gun offenders to prison for decades. Stop harrassing lawful gun owners with Un-Constitutional gun laws.

    The police chief down here in New Orleans, to save his job, he has adopted this
    same Unconstitutional Gun Registry ordinance, but they’re having trouble getting it passed, because a few Conscious Brothers are vigilantly opposing this
    illegal act, so the powers that be are trying their damnest to sneak it in under the radar.
